watt ever continuing -- water continuing to pour from this intersection in hayward after a water main burst earlier this morning. one thing i hope we can focus on is to put a package like this together with a little bit less drama. >> the long national drama over the fiscal cliff is over after a late night vote on capitol hill. unless you are due for a pay rise or a promotion, you will see less money in your paycheck. we'll explain what tax holiday is expiring. frosty numbers out there on the lows. afternoon high temperatures looks like they'll actually warm up a little bit. time for the second hour of the ktvu morning news.

good morning, to you. welcome to wednesday, january 2nd i'm dave clark. >> and i'm claudine wong in pam cook this morning. let's start off with that quick look at your weather and traffic. steve, we can't stop talking about the cold temperatures out there. >> well, yeah. 27 is cold. 26 is cold. not as bad near the coast or the bay but still frost advisory or freeze warning out. i have seen 26, 27 outside of sonoma. look at that concord 29. fairfield 27. napa 29. there is cold numbers but it will be sunny today and a little bit warmer. here is sal. steve, good morning. this is a live look at downtown san jose. northbound 280 coming right through. you can see the traffic is moving along very nicely all the way into the silicon valley or into the west valley. let's move along and take a look at westbound 92 that looks good. now back to the desk. time now 6:01 developing news we've been on this since 4:30. there is a water main break in

hayward. ktvu alex savidge was there first. he's with us now. what is happening and he's checking on things as we're speaking to him. when i get your attention, i want to know what is happening now. i can see the street over your shoulder and how is traffic effected? >> reporter: traffic is still a problem here. several lanes shut down in both directions here at the intersection of jackson and santa clara street. as you can well see water still pouring up out of the roadway. this has been going on for the last 2.5 hours. this water main burst early this morning. we are getting new information right now from the police lieutenant here on scene that just told me a short time ago this is a very good size water main that burst. a 12-inch water main that broke. right in the middle of the intersection. obviously causing all these problems this morning. and lieutenant just arrived here on scene. what is the update as far as the work that city crews are doing right now? how long until the water can be shut off? >> we're hoping a half hour to

45 minutes for an update. water crews are trying to do their best to actually shut down the water. they've been able to do a lot of progress in shutting down the water. >> reporter: why is this such a complicated effort? i know firefighters were here trying to turn off the value ever. why is this more complicated? >> it's a larger break. it's a 12-inch main pipe that was broken. to find out exactly where the valve is to shut it off has been a challenge. >> reporter: in the meantime you were telling me earlier water service not effected in this area. obviously the big issue and the big concern for the hayward police department is the traffic in this area. as you can see several lanes of jackson are shut down in the eastbound direction. obviously a left hand turn lane shut down here. obviously santa clara traffic not getting through as well. this is right mike to 8 --

right next to 880 people are getting on the traffic here. live this morning in hayward alex savidge. the fiscal cliff is now a done deal. the house of representatives passed a senate bill that protects 99% of americans from an income tax hike. >> central premise of my campaign for president was to change the tax code that was too skewed toward the wealthy at the expense of working middle class americans. tonight we have done that. >> president obama is right now flying back to hawaii to resume the family vacation that he cut short to deal with the fiscal cliff. here are just some of the details of the fiscal cliff deal passed last night. a permanent extension of previous tax cuts for all taxpayers expect for individuals making more than $400,000 a year. or couples making $450,000. the bill also continues unemployment benefits to long- term jobless for another year. and it does postpone decisions

on controversial spending cuts for two months. u.s. stock futures are occupy this morning as investors are expected to rally once the markets open in this country now that the fiscal cliff has been averted. that is on lead of all the major european markets. most asian markets that were open were also encouraged by this budget deal. hong kong closed with a nearly 3% gang. south korea was up nearly 1.7%. the action by congress to prevent income tax hikes for most americans doesn't mean your paycheck is safe. janine de la vega is live for us in san jose to explain why your next paycheck will still be smaller because of the end of the payroll tax holiday. >> reporter: this payroll tax cut expired on december 31st of 2012. the less money people have to take home the less they have to spend. here's a break down of some

examples. the average family making $50,000 a year will see their paychecks drop by $1,000 a year. the average family making $75,000 a year will see $1500 less a year. the average family making $100,000 a year will see a decrease of $2,000 annually. one man we spoke to this morning said he's been watching what has been happening in congress and reacted to how this will effect people's paychecks. >> it will be hard for everybody. but you know it's really a long- term view. we need to pay back that money so that everyone is going to be able to benefit by the social security. somebody who is really, really pour will have a tough time for it. americans were enjoying a boost in their paychecks. it lowered the social security tax but now it's bunking back

to 6-point -- but now it's bouncing back to 6.2%. it was put in place to boost the economy. the ending of the tax holiday wasn't even a bargaining chip in the fiscal cliff talks. reporting live from san jose janine de la vega ktvu channel 2 news. the last minute deal to avoid the fiscal cliff prevented an income in taxes. coming up at 6:15 the two big pieces of unfinished business. the new session of congress will have to deal with in the coming weeks. time is 6:07. a deadly high speed crash in san francisco right outside of a liquor store is still the focus of a police investigation and the arrest of the driver was all caught on video. this happened yesterday morning. you see the police officers have guns drawn. moving in on the unidentified suspects car. the suspect was arrested.

he's being treated for minor injuries police also say they found a gun inside the car. minutes before the arrest though the driver crashed into a white toyota at 21st and south vaness. sending it flying through a liquor store. police say this all started with an earlier report of shots fired from a car at a nearby public housing complex. police later pulled over the driver but the driver sped away. >> as officers approached the vehicle, the vehicle took off at a high rate of speed and ran through the next two intersections colliding with the white vehicle. >> now a 26-year-old pedestrian who was just walking into that liquor store died at the scene after being hit by the car. there were two people in the toyota. passenger, a woman in her 20s died there at the scene. the driver suffered life threatening injuries. your time 6:08. let's go out to sal castaneda and sal, i know a lot of people

concord 29 degrees. there is a lot of low 30s. few 40s closer to the bay. sonoma outside the square 27. yountville and knapp ma closer to town -- and napa closer to town. lafayette, alamo, pleasant hill. one below up in tahoe. i think truckee is four below. 26 ukiah. 29 sacramento. it's cold. northern california all all the way down to southern california as well. another system approaching but it's just absolutely falling apart. it doesn't have the jet stream nit favor. part of the jet stream goes south. part goes north and we are left between. as you can see in the cloud and rain forecast the system runs into a wall of high pressure. we will get higher clouds out of it. that is about the end result. otherwise it simply can't do much. we had the jet stream right over us for the longest time. parts north and south between.

all right happening now a new york city bus terminal just reopened after a natural gas scare. you're taking a look live at the scene in manhattan this morning where you can see emergency crews underneath that overpass right there. things are backing up there because that terminal was shut down for a short period of time. there were cans about a -- there were concerns about a strong smell of natural gas.

they did evacuate that terminal. but the all clear was given about ten minutes ago. so things should be slowly getting back to normal. again you can see emergency crews still on scene there. new years day extensive search for a man that was swept out to see in marin county came to an end when authorities recovered his body. that man was walking with his wife and dog in north beach around 12:30 yesterday. that is when a wave swept the couple and dog into the water. bystanders did pull the woman to safety and the dog also made it back to shore it took hours but around 4:00 p.m. the coast guard found the man's body. the children who survived the connecticut shooting rampage are about to go back to school tomorrow. they will not however go to sandy hook elementary where a gunman killed 20 children and six adults last month. instead they will be going to a nearby vacant school. a school that is transformed to look just like their old classrooms. the kids will have the same

desk even the walls are going to be painted the same colors. the classes begin tomorrow but today there will be an open house. connecticut lawyer is dropping plans to sue the state over the sandy hook school shooting. irving accused the school of not protecting students. he was planning to seek $100 million in damages on behalf of a six-year-old girl who survived that shooting massacre. he received dozens of threatening messages about his lawsuit. accusing him of trying to profit from the tragedy. it's not clear yet if those messages have anything to do with that decision to drop the lawsuit. they missed their dead line -- deadline by 24 hours but they did calm financial fears. as kyla campbell reports economists are split on the outcome. kyla. >> reporter: the big fear in the last few weeks was how

investors would react. asia kicked off the year with fire works thanks to the fiscal cliff deal here in the u.s.. after completing the deal they held off most of the expected impact. u.s. stock futures were also up sharply and will get a closer look at the opening bell in 20 minutes. despite the positive news economists say we're not out of the woods just yet. they have to raise the debt ceiling soon. >> while i will negotiate over many things, i will not have another debate with this congress over whether or not they should pay the pill bills they have already racked up through the laws they passed. >> reporter: the president said with those upcoming to base he hopes for less drama and congress went scare americans like they dead. >> we do have more on the

declare victory and run. american led nato troops are due to pull out of afghanistan by the offend 2014 leaving behind what is called a viocid yule force. new years celebration at the hindu temple in fremont was somber this year as hundreds remembered a woman in india who died after being gang raped. worshipers held a candle light vigil to play prey for the victim and call to the end of violence against women. protests have been held around the world to call for stricter penalty for rape following the woman's death. five men and a teenage boy are accused of beating and gang raping the 23-year-old medical student. >> they are human first and that's what we have to stand for. >> 600 rapes are reported in new delhi last year but there has been just one conviction. 6:25. san francisco police are busy

searching for two criminal ascussed of punching a 75-year- old woman and stealing wigs from a store. this all happened sunday afternoon on polk street. police say the suspects left the store without paying for those wigs and when they were confronted by the woman, police say one of the men punched her in the head. both of those suspects ran away. they are described only as between 25 and 30 years old. according to a new report all sugar is not the same but a new study is suggesting fructose sugar may lead to obesity. imaging tests show that fructose can trigger brain changes that can cause overeating. it's a small study that found after -- the brain doesn't register the feeling of being full. although this research doesn't prove that fructose causes obesity it does add to the evidence that it contributes to it. time now 6:26. sal is back. our commute is starting to wake

company. the big news with the fiscal cliff averted futures pointing to a good day. chunk for join -- thank you for joining us. it's wednesday, january 2nd i'm dave clark. >> and i'm claudine wong. pam cook is off today. we are following developing new from the east bay. a water main break is causing traffic problems in hayward. alex savidge is at the scene on jackson street with why it's take song long to shut that water off. >> reporter: crews out here from the city of hayward from the water department and street department are really at this point trying to isolate the break along this water main. it's at a very busy intersection. once where they can find where that break is they can use something called a valve key to shut off the water. the latest update we got from police lieutenant is that crews are hoping to have the water turned off in some time in the next hour. as you can see it's still pouring up from the roadway. we are told this is a 12-inch water main. a 12-inch pipe that broke early this morning. that is a very large line.

and obviously it's closed down several lanes of traffic here at jackson and santa clara streets. this is right near the entrance to 880. we were first on scene shortly after the water main broke. firefighters first moved in to cut off the flow of water. the situation was a bit more complicated. that is why the water department was called in. they're now using that special tool to isolate the break. isolate the correct valve that will turn off the water in this area and stop the flow. the police lieutenant i talked to said once crews can control the flow of water, officers will start opening up more lanes of traffic. >> once the valve is actually shut off we actually have to repair the pipe so water can flow. that is probably -- and there will still be some traffic congestion at this intersection. how much we really don't know. we'll have to decide when the city crews look at the actual work that needs to be done in order for them to figure out how much of the intersection will be blocked.

>> reporter: meantime the lieutenant is telling me water service in this area has not been effected for anyone as a result of this ruptured pipe. that means businesses and homes do still have water service right now. although he cautions that could potentially change once they turn off the flow of water here. obviously there will be repair work that has to be done on this under ground water line and potentially we're talking about service interruptions in this area. again crews are trying to isolate the rupture. isolate the break on this water line. and they're hoping to do that at some point in the next hour. we'll stay out here and bring you updates throughout the morning. for now we are live in hayward alex savidge. while crews work through the night to fix another water main break and this one was in concord it happened just before 6:00 last night. officials say no one lost water and no homes or businesses or damaged. 6:33. boy it is cold around most of the bay area. and we have a freeze warning

this morning. ktvu tara moriarty is live in walnut creek. she's been out there shivering since 4:30 this morning. now you can tell us where it's freezing or even close to freezing. >> reporter: it is pretty cold here. you can see my breath. still 29 degrees. we have seen a lot of people out jogging trying to keep warm. and going to the local coffee shops. behind me here this is the bank -- it just changed. it said 29 degrees. freeze warning for the north bay valleys and mountains. frost advisory in effect. the bone chilling temperatures of people -- >> we get to buy some coffee. >> pretty cold. >> pretty cold. >> i have a sweater and i've got my jacket. >> reporter: you have four layers? the air day even though it's cold it is illegal to light fire logs or pellets. luckily it hasn't been raining. there is not a lot of ice on the roadways. temperatures will thaw later today. get into the high 40s and mid 50s. tomorrow and friday it will be pretty cold. this weekend it should warm up. steve will have a lot more on that coming up. i'm tara moriarty. right now president obama is on his way back to hawaii to join his family vacation after the house of representatives passed a last minute deal to avoid that fiscal cliff. the president left after the house approved the bill. >> thanks to the votes of democrats and republicans in congress, i will sign a law that raises taxes on the wealthiest 2% of americans while preventing a middle class tax hike that could have sent the economy back in a

recession. >> i wish i could say this is a proud moment. a moment in which we started the year off right. in which the first of january was the first of great many good things. it isn't. we are kicking the can down the road. >> new members of congress are going to be sworn in tomorrow over the next two months. they will have to resolve the issues this last minute deal did not address which includes the u.s. debt cut and spending cuts. the deal to avert the fiscal cliff has many in holiday celebrate -- in hollywood celebrate. and that caused an outcry from new york area lawmakers. >> i truly feel betrayed. one of congress' most basic responsibilities is to help families. communities, businesses recover. >> the senate already passed a

$60 .4 billion measure. the house was expected to vote on it. republican leaders say the deal took so much time they didn't have anything left to discuss the sandy bill. 6:36. troubling trends reported by oakland police as they try to reduce violence in the city. 131 people were killed in oakland in 2012. police are telling the oakland tribune in some of the gang related killings the attackers planned and practiced before carrying out the attacks. the use of a pure form of the drug ecstasy is making the attackers even worse. city leaders have hired former los angeles police chief bill bradden to come in as a consultant. and howard jordan is bringing back neighborhood policing to try to reduce crime. this morning police in san jose are investigating how a man who stripped naked and waved a samurai swords during a standoff was able to get ann assault rifle. police say this all began about

8:00 yesterday morning when police responded to a 911 call about a man who had an assault rifle in front of a house. he took off in a truck. they followed him to a light rail station that is when he stripped off his clothes and started waving a samurai sword. >> his statement was you're going to have to kill me. he stated that several times. >> after a two-hour standoff the man tried to climb a fence but he fell dropping that sword. they also found a loaded assault rifle in the man's trunk. authorities are trying to figure out what caused a deadly new years eve collision. it killed four people. two women and one man from fairfield ages 23, 28, and 31 died in the hyundai. a 42-year-old man from tracy died in the toyota. the victims names have not been released.

small business owners are worried about a new policy that will end free metered parkings on sunday. it will require drivers to pay at all metered spots from noon until 6:00 p.m. on sunday. that parking program will help increase turnover in local business districts. but some small business owners tell the examiner they fear it will drive customers away. time now 6:30. just about 6:39. sal, how is 880 doing? >> 880 looks pretty good dave and claudine. if you have to hit the road and go into the office today or do your job it should be a nice job far you. westbound 580 traffic looks good coming out to the mccarthur maze. if you have to go to work at least it's a little lighter than it normally is. by next time this week we will probably see it backed up to the maze. take advantage of that. peninsula traffic looks good if

year or for a couple that earns $450,000 a year. back here at home broken water main problems in hayward. it's partially closed jackson and santa clara street. this happened about 3:30 this morning. repair crews are out there trying to shut the water off and fix that water line now. and police in san francisco investigating a deadly high speed crash outside of a liquor store. two people were killed. a third person suffered life threatening injuries. the driver accused of the crash was taken into custody. people in san francisco are complaining more than ever about their experiences with taxi cab drivers. ktvu channel 2 reporter brian flores joins us from the city with more on what they're complaining about. >> reporter: if you ever been in a cab here in san francisco for many people the experience has been just fine but for many others the experience hasn't been so great.

according to an article by the bay citizen about 1700 passengers complained to the city about their experience in a taxi cab. riders can complain to the dedicated 311 complaint line. in july of 2011 and july of 2012 there was a 3% increase. here are some of the complaints that people listed to the city. they include several instances of taxi drivers driving unsafely on the roads. there are complaints that drivers would refuse to take credit cards. there was one incident that saw a passenger aalleged a driver stole his credit card number. there is also complaints of drivers racial profiling. using cell phones while driving. there is a complaint of bedbugs in one cab. according to that article that situation was taken care of. but despite the amount of complaints some passengers we spoke to say compared to other cities san francisco cabs are just fine. >> my experience it's basically been the same thing. i'm a bicyclist. i ride my bike.

million in incentives. time is 6:48. a small special needs school in santa rosa is asking for help. they want to catch the thieves that robbed the school during the christmas holidays. it's the new horizons learning center. this school serves about 20 teenagers with learning disabilities. over the holiday break burglars stole cash, school van, and computers with software for those students that have dyslexia and other learning disabilities. >> these are kids that don't have laptops. they do not have ipads. they often come from very difficult situations and they are only hands on time will be here. >> the teachers say the biggest loss that school van. 2003 gold honda odyssey. they say they desperately needed for their student activities. the mayor of palo alto won a friendly rose bowl wager. bet that stanford university would beat the university of

wisconsin madison. the mayor of madison lost as the cardinals beat the badgers 20-14. according to the terms of the wager he must now wear a stanford cap at a city council meeting and has to fly the stanford flag in madison and plant a tree in stan ford's honor. >> that's what happens when you lose. time 6:49. it's slow in oakland? >> it is slow because of a crash. southbound 880 near fruitvale. it's backing up to 23rd. it started off as not being is a big traffic jam but now that more people are on the road it's causing an unexpected delay as you head down. you may want to give yourself a little extra time. or if you can somehow get on the freeway after fruitvale you will save yourself plenty of time. you can see after fruitvale it looks great. northbound traffic is largely uneffected by that crash. bay bridge toll plaza is not a big delay at all. there was a slight delay.

now let's go to steve. thank you, sal. we have clear skies. can be a patch or two of fog to the north. it's mainly cold. but not so much along the coast. i just half-moon bay airport is 48 degrees. with a little east breeze. not as cold there. you can find colder temps. freeze warning is north bay down to the sow lyonnais valley. one more hour and then we'll start to see temperatures rebound. one below in tahoe. four below in truckee. mammoth is eight below. next system coming in is going to fall apart. at best we'll get higher clouds out of it. the pattern you can see it looks good. the last few frame what is happens this energy goes north. this low will go right here. we don't get anything out of that. it's a dry pattern for awhile. maybe for a week or two. that's the way it's looking to me. sunshine light breeze.

investigators in france stole more than a million dollars worth of merchandise from apple store in paris. suspects were armed they had on masks. police say they were well prepared. and they stole $1.3 million in

merchandise. a los angeles paparazzi photographer died while trying to take photos of justin bibberies car -- justin bieber's car. the photographer was trying to take pictures while officers talked with bieber's friends in that car when he was hit and killed by another car. lapd is now investigating. the city of oakland is expected to begin issuing identification cards to illegal immigrants beginning next year. san francisco has a similar id card system. there is also a program in the works in richmond. oakland's id cards will also act as debt cards. the idea is to make it easier for illegal workers to cash their checks to prevent them from walking around with large amounts of cash. critics are saying the program ligitimizes illegal immigration. 49ers have signed a new kicker.
